4. GENERAL PROVISIONS
These provisions establish the common conditions applicable to the use of Locationow and to relationships between Locationow, production companies, owners and other platform users.
4.1. Role of Locationow
Locationow acts as a platform and intermediary between location owners and production companies, agencies, businesses and professionals interested in using them for filming, photo shoots, events and other productions.
Locationow facilitates the search for locations, communication between the parties, viewing coordination, request management and intermediation in the booking process.
Unless expressly agreed otherwise, Locationow is not the owner, landlord or user of the locations and is not a party to any specific usage agreement entered into between the owner and production company.
Each party is responsible for complying with the obligations applicable to it under law and the conditions agreed for each project.
4.2. Information provided by users
Owners and production companies undertake to provide Locationow with truthful, complete and up-to-date information.
The owner is responsible for ensuring that information about the location is correct, including characteristics, photographs, availability, conditions of use and relevant limitations.
The production company is responsible for ensuring that project information is sufficiently accurate for the owner to properly assess the request.
Any relevant change must be communicated to Locationow as far in advance as possible.
4.3. Location availability
Information concerning a location’s availability is indicative until the owner has expressly confirmed availability for a specific project.
Publication of a location on Locationow does not guarantee availability on a particular date.
Availability must be confirmed before each booking is formalised.
4.4. Communications
Communications concerning requests, viewings, bookings, changes, cancellations or any other project matter may be made through channels provided by Locationow or by other means that reasonably allow their content and date of receipt to be evidenced.
Locationow may use email, telephone, messaging or other customary communication methods to facilitate coordination between the parties.
The parties must keep their contact details up to date and provide a valid means of communication throughout the booking and project execution process.
4.5. Data protection
Personal data of production companies, owners and other users will be processed in accordance with applicable data protection law.
Information concerning the processing of personal data, purposes, legal bases, user rights and other related matters is set out in Locationow’s Privacy Policy.
4.6. Intellectual property and location content
Owners who provide photographs, videos, text, plans, logos or other materials relating to their locations authorise Locationow to use them for publication, promotion and commercialisation on the platform and through Locationow’s own channels.
This authorisation remains in effect while the location forms part of Locationow’s catalogue unless the parties agree otherwise.
The owner warrants that they hold the necessary rights, permissions and authorisations for the materials provided to Locationow.
Locationow may not use such materials for purposes unrelated to the promotion and commercialisation of locations without the relevant authorisation.
4.7. Use of the platform
Users undertake to use Locationow responsibly and in accordance with applicable law and these conditions.
The platform may not be used to provide false or misleading information; carry out unlawful activities; deliberately harm other users; access or attempt to access third-party information or accounts without authorisation; use information obtained through Locationow for purposes unrelated to the production or booking of locations; or carry out activities that may harm Locationow’s operation, security or reputation.
Locationow may take reasonable measures where it detects fraudulent, abusive or otherwise non-compliant use.
4.8. Direct relationship between the parties and non-circumvention
Locationow facilitates contact between owners and production companies with the aim of creating booking opportunities.
Where a production company learns of a location or its owner through Locationow, it may not use information or contact details provided by Locationow to deliberately circumvent its intermediation and contract directly for the purpose of avoiding the applicable commission.
This obligation also applies to bookings arising from the project initially introduced by Locationow or to substantially related projects.
The specific terms and, where applicable, the period during which this obligation remains in force may be established in the specific conditions applicable to each relationship.
4.9. Locationow’s liability
Locationow will perform its intermediary services with due care, but does not guarantee that all requests made through the platform will result in a booking or that a particular location will be available for a specific project.
Locationow will not be liable for damage, breaches, delays, cancellations, accidents, breakage or disputes arising directly between a production company and an owner, except where liability must legally be attributed to Locationow for its own acts or omissions.
Responsibility arising from the actual execution of filming, use of the location and compliance with specific project conditions rests with the parties directly involved.
4.10. Changes to the conditions
Locationow may update or modify these conditions when necessary to adapt its operation, services, business model or legal requirements.
Changes will be published on the platform and may be communicated to users where necessary.
Unless otherwise required by law, the conditions applicable to a booking will be those accepted by the parties when the booking is confirmed.
4.11. Suspension or removal of a location
Locationow may temporarily remove a location from the catalogue where there are reasonable grounds to do so, including outdated information, lack of availability, breach of conditions, repeated incidents or any circumstance that may affect proper service provision.
Removal from the catalogue will not, by itself, affect bookings already confirmed unless there is a reason justifying cancellation.
4.12. Force majeure
Locationow will not be liable for failures or delays arising from circumstances beyond its reasonable control.
Force majeure may include natural disasters, extreme weather, fires, administrative restrictions, conflicts, interruptions to essential services, widespread communications failures or any other unforeseeable and unavoidable circumstance that reasonably prevents performance of obligations.
When such a situation occurs, Locationow will endeavour to inform affected parties and assist in finding a reasonable solution.
4.13. Applicable law and jurisdiction
These conditions are governed by Spanish law, without prejudice to mandatory rules that may apply depending on the status of the parties and the nature of each contractual relationship.
Where legally permitted, any dispute arising from use of Locationow or these conditions will be submitted to the courts and tribunals having jurisdiction under applicable law.
4.14. Severability
If any provision of these conditions is declared null, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining provisions.
The affected provision will be interpreted or replaced, to the extent legally possible, so as to come as close as possible to the original intended purpose.
4.15. Contact
