Conditions for location owners

3.1. Registration and inclusion of the location on Locationow

The owner may request that their property, space or location be included in Locationow’s catalogue to make it available to production companies, agencies, businesses and professionals seeking spaces for filming, photo shoots, events or other productions.

Inclusion in the Locationow catalogue is completely free for the owner. No registration, maintenance, publication or listing fees will apply.

Locationow may request information, photographs, characteristics, availability and other data needed to prepare and publish the location correctly.

The owner warrants that they have the necessary rights and authorisations to offer the location for the stated uses.

3.2. Non-exclusivity

The collaboration between the owner and Locationow is non-exclusive.

The owner may offer the location simultaneously through other platforms, agencies, intermediaries or directly to production companies and clients, without its inclusion on Locationow preventing this.

The owner may also freely decide which booking requests to accept or reject, provided previously confirmed bookings are respected.

Inclusion of a location on Locationow does not oblige the owner to accept any filming or production request.

3.3. Published price and final project price

The price shown in Locationow’s catalogue is indicative or estimated only.

The published price may be expressed per hour, day or another reference unit and is intended to provide production companies with an initial indication of the cost of using the location.

The final price for each project will be determined on a case-by-case basis, taking into account the specific characteristics and requirements of the production.

Factors may include filming duration; access, set-up and breakdown times; number of people; number and type of vehicles; use of different areas; technical requirements; furniture or additional elements; production requirements; exclusivity or use restrictions; special cleaning, security or staffing requirements; and any other project-specific circumstance.

Accordingly, the indicative price published on the website is not a definitive offer and does not oblige the owner to accept a booking at that amount.

Before a booking is confirmed, Locationow will communicate the specific project conditions and proposed price to the owner, and the booking will require the owner’s acceptance.

3.4. Locationow commission

Locationow will not charge the owner any amount for including or maintaining the location in the catalogue.

When a booking results from Locationow’s intermediation or management, Locationow is entitled to a 10% commission on the agreed booking amount.

The commission will also apply to additional amounts subsequently agreed as a result of extended hours, additional days, extraordinary services or other changes to a booking managed by Locationow.

The commission is separate from any taxes applicable to either party.

3.5. Invoicing and payment

The production company or client will pay the owner directly the amount corresponding to the booking, in accordance with the agreed financial terms.

Once the owner has received the booking payment, Locationow will issue the owner an invoice for its 10% commission.

The owner undertakes to pay that invoice within the period stated on it.

Where another collection or invoicing system is expressly agreed for a particular project, the specific terms communicated and accepted by the parties will apply.

3.6. Booking confirmation

A request received through Locationow will not be considered a confirmed booking until the owner has accepted the essential project conditions.

Before confirmation, the owner should know, to the extent available, the main characteristics of the production, including dates, times, approximate number of people, intended use of the location, special requirements and agreed price.

Locationow may act as an intermediary between the owner and production company to facilitate negotiation and booking coordination.

Once a booking is confirmed, the owner undertakes to respect the agreed conditions unless there is a justified reason or a change is expressly agreed with the production company.

3.7. Public liability insurance

For a production to take place, the production company must have adequate and sufficient public liability insurance covering the risks arising from the activities to be carried out at the location.

Locationow may request evidence of the existence and validity of this insurance from the production company and, where necessary, provide such information to the owner.

The owner may request additional documentation concerning the production company’s insurance coverage before production begins.

The existence of public liability insurance does not limit the production company’s liability for damage caused during production.

Locationow acts as an intermediary and does not replace the production company’s insurance obligations or guarantee coverage for damage occurring at the location.

3.8. Deposit or security deposit

The owner may require the production company to provide a deposit or security deposit before filming begins.

The amount, method of payment, return conditions and circumstances in which the deposit may be applied will be agreed between the owner and production company before the booking is confirmed.

The deposit may cover, among other things, damage, breakage, loss, extraordinary cleaning, costs arising from breaches or any other expressly agreed cost.

Unless expressly agreed otherwise, Locationow will not hold or manage the deposit; the owner and production company will agree its terms directly.

3.9. Filming agreement

Locationow has a contract template that may be used to formalise the conditions of each production.

However, the owner may use their own contract template if preferred.

The contract may establish specific filming conditions, including dates, times, price, deposit, insurance, authorised uses, areas of the property, responsibilities, damage, cancellations and any other specific condition.

Where the owner’s own contract is used, Locationow may assist with coordination between the parties to facilitate its formalisation.

3.10. Changes, additional hours and extraordinary services

Any material change to the conditions initially agreed must be communicated to the owner and, where appropriate, must receive the owner’s approval.

Additional costs may arise from extended filming hours; additional set-up or breakdown hours; additional days; a significant increase in people; use of areas not initially included; additional use of furniture, facilities or equipment; extraordinary cleaning; staffing, security or other services; or any other change that increases costs or inconvenience to the owner.

Additional amounts should be agreed with the owner before the change takes place whenever possible.

Additional amounts relating to a booking managed by Locationow will also be subject to the 10% commission.

3.11. Damage, breakage and production company liability

The production company is responsible for damage, breakage, loss or deterioration occurring at the location, its facilities, furniture, decorative elements or property during production where attributable to the production company, its crew, suppliers, collaborators or persons participating in the shoot.

The production company must return the location in conditions equivalent to those in which it was received, except for normal wear arising from authorised use.

Costs arising from damage, repairs, replacement or extraordinary cleaning may be claimed by the owner from the production company and, where applicable, may be offset against the deposit provided.

Locationow may assist with communication and management of incidents between the parties but will not directly assume responsibility for production-related damage unless legally required to do so.

3.12. Cancellations

Cancellation conditions for each booking must be established before confirmation, either through the filming agreement used by the parties or through specific conditions accepted for the project.

Depending on the circumstances of each production, cancellation fees, non-refundable advances or cancellation compensation may be established.

When a confirmed booking is cancelled, the applicable financial conditions will be those previously agreed between the owner and production company.

If a cancellation generates an amount payable to the owner, Locationow’s commission will be calculated according to the financial conditions established for that booking.

3.13. Owner’s right to reject requests

The owner retains the right at all times to accept or reject production requests received through Locationow.

The owner may freely assess whether the project is compatible with the location, including its content, dates, times, number of people, production requirements, possible inconvenience, risks and any other circumstance.

Receiving a request does not create any obligation to accept it.

Once a booking has been accepted and confirmed, the owner must respect the agreed conditions and notify Locationow and the production company of any circumstance that may prevent or alter the project.

3.14. Removal of a location from the catalogue

The owner may request the removal of their location from Locationow’s catalogue at any time.

Removal will not affect bookings already confirmed, unless the parties agree otherwise or there is a justified reason for cancellation.

Locationow may temporarily or permanently remove a location where necessary for legal, safety, information-quality, breach-of-conditions or other justified reasons.

3.15. Relationship between Locationow, owner and production company

Locationow acts as an intermediary and facilitator between location owners and production companies or clients interested in using them.

Inclusion of a location on Locationow does not make Locationow the owner, landlord, occupier or responsible party for the location.

The specific conditions of each production will be agreed between the owner and production company, without prejudice to Locationow’s role as intermediary and manager of the commercial relationship.

The owner is responsible for ensuring that they have the right to authorise use of the location for the production and for informing the parties of any limitation, restriction, administrative authorisation or specific condition that may affect filming.

The production company is responsible for the activity carried out during filming, its crew, suppliers and collaborators, and compliance with the agreed conditions for use of the location.

Locationow may intervene to facilitate communication, coordinate the booking and help resolve incidents, but will not assume the obligations belonging to the owner or production company.
